Right after we initially launched our merch store, Trader Joe’s union-busting legal team got right to work, suing us for trademark infringement & claiming consumers might be “confused” between their products & ours.
Well, we fought back with a motion to dismiss, and called their move for what it was: blatant union-busting and retaliation meant to stop our union’s momentum. Last Thursday we went before a judge, and he clearly saw it too.
While there’s no official ruling yet, U.S. District Judge Vera said,
“I can’t imagine that Trader Joe’s really cares about buttons and mugs. So, I have a hard time thinking this is a true, good-faith commercial dispute.”
Unlike Trader Joe’s, we don’t have unlimited resources and an army of anti-union lawyers at our disposal—and selling merch is one of the few avenues our union has to raise funds while we attempt to achieve our first contract.
They know that, which is why they launched this frivolous suit in the first place.
Trader Joe’s is pulling out all the stops to delay the bargaining process, and keeping us tied up in legal battles is just one way that they hope to get our members to turn their backs on the union.
